Legal Design in banking and finance law: Intersection profiles with behavioral finance

Legal Design in banking and finance law: Intersection profiles with behavioral finance

Francesco Vella (Università di Bologna), Gianfranco Liace (Università di Salerno)

The paper analyzes Legal Design as a methodological tool to improve the comprehensibility and effectiveness of regulations and documentation in banking and financial law. Integrating the teachings of behavioral finance, the Legal Design allows to counteract savers’ cognitive biases (loss aversion, anchoring, decision-making inertia), overcoming the limits of traditional information disclosures. Particular attention is paid to digital services, where design techniques (summary boxes, interactive visualizations, nudges) can strengthen customer protection and the adequacy of investment choices.
