New Technologies and Legal design in Banking and Financial contracts

The evolution of legislation protecting customers, especially consumers, and the change in the way customers interface with suppliers of goods and services resulting from the application of new technologies have made the need to draft contracts and pre-contractual information documents in a simpler and more comprehensible manner more urgent. In the same direction pushes the need to improve customer relations and reduce the risk of litigation. Legal design is a useful tool in the pursuit of these aims, provided that the regulatory compliance and «resistance» in court of documents drafted by applying its methodologies are assessed. The article reports the outcome of some reflections on the subject, with particular reference to contracts governed by Title VI of the Italian Consolidated Banking Law.
